Rent can’t be gouged

Penal Code §396 caps increases at 10% during the emergency, on renewals and new listings alike. Report gouging to the CA Attorney General (800) 952-5225.

Your lease & deposit

  • Unlivable unit? Civil Code §1933/§1942 can end or suspend rent.
  • A landlord can’t keep your deposit for fire damage you didn’t cause.
  • Evacuating isn’t abandoning your tenancy.

For owners

Stay compliant on rent

Keep any increase within the §396 10% cap — including re-listings. RSO and AB 1482 limits still apply on top.

Damaged units & tenants

  • An uninhabitable unit may end the rent obligation; handle the deposit and prorated rent correctly.
  • No-fault displacement can trigger relocation assistance.
