Moving Out of Your NYC Apartment: The Complete Checklist

Moving out in New York involves more moving parts than most people expect — notice deadlines, elevator reservations, a walkthrough, and a deposit that only comes back if you handle the process right. Here's the full timeline. This is educational information, not legal advice.

60-30 days before: give proper notice

If you're on a month-to-month tenancy, New York requires at least 30 days' written notice before your next rent due date (Real Property Law § 232-a in NYC). If you're on a fixed-term lease that's simply expiring, you may not be legally required to give notice at all — but check your lease for its own notice clause, and send one anyway as a courtesy and a paper trail. 3-4 weeks before: logistics

  • Book your building's elevator/loading dock — many NYC buildings require advance reservations for move day, with a certificate of insurance from your moving company.
  • File a USPS mail forwarding order at usps.com/move.
  • Schedule utility shutoffs/transfers for your move-out date.
  • Send your landlord your forwarding address in writing — your deposit has to go somewhere. See our change of address notice.

1-2 weeks before: prep the apartment

  • Compare the unit's current condition against your move-in inspection checklist, if you filled one out — it's your best evidence of what condition you're responsible for versus normal wear and tear.
  • Handle any repairs you're responsible for causing (not just cleaning).
  • Take dated photos of every room, cleaned and empty, before you hand back keys.

Move-out day

  • Do a walkthrough with your landlord or property manager if they'll join you — a signed condition checklist at move-out is strong protection if a deduction is disputed later.
  • Return all keys and fobs, and get a receipt or written confirmation that you did.
  • Confirm your forwarding address one more time in writing.

After you leave: your deposit

Under General Obligations Law § 7-108, your landlord must return your deposit — minus any lawful, itemized deductions — within 14 days of your move-out, along with a written statement of any deductions. If that 14-day deadline passes with nothing, send our security deposit demand letter; if that's ignored too, escalate with our small-claims final notice.
