Change of address / forwarding notice to landlord (NY)

Legal advice recommended before use.

Under New York General Obligations Law § 7-108, a landlord must return your security deposit (and any itemized statement of deductions) to the address you specify — or, if you haven't given one, to your last known address. A short written notice puts your new address on record, so there's no excuse for a late or misdirected refund.

Send this by a method you can prove (certified mail or email with read receipt) and keep a copy — it's your proof that the landlord had your correct address if the deposit is late or misdirected. Also file a mail forwarding order with USPS as a backup. This is a template, not legal advice. This document was drafted without live legal-citation verification (research budget was exhausted) and has not yet been reviewed by an attorney — do not rely on it as final.

Frequently asked questions

Do I have to send this in writing?

You're not legally required to, but a written, dated notice is strong proof that your landlord had your correct address — which matters if your security deposit is late under GOL § 7-108's 14-day return requirement.

When should I send it?

As soon as you know your new address — ideally with your move-out notice, or right after you vacate. Sending it before you leave gives the landlord no excuse to claim they didn't know where to send your refund.

What if my landlord still sends my deposit to the old address?

Keep proof of when you sent this notice. If GOL § 7-108's itemized statement and refund don't arrive within 14 days of move-out at the address you provided, you can follow up with a security deposit demand letter.

Should I also file a USPS mail forwarding order?

Yes — this notice tells your landlord where to send deposit-related mail, but a USPS forward (usps.com/move) catches everything else for the transition period.

Do I need to give a reason for moving?

No. This is a simple factual notice — you don't need to explain why you're moving, only where to send things going forward.
