Landlord consent to sublet form (LA / California)

Legal advice recommended before use.

Where a California lease requires the landlord's consent to sublet but doesn't set its own standard, Civil Code §1995.260 implies that consent may not be unreasonably withheld — and a landlord's failure to respond in writing within a reasonable time to a tenant's written request can itself be treated as consent under §1995.240. This short form documents the request and the landlord's decision, protecting both sides.

Frequently asked questions

Does my LA landlord have to have a reason to deny a sublet request?

If your lease requires consent to sublet but doesn't state its own standard, Cal. Civil Code §1995.260 implies that consent may not be unreasonably withheld — a landlord generally needs some legitimate, non-discriminatory basis, not an arbitrary refusal.

What happens if my landlord just never responds to my sublet request?

Under Cal. Civil Code §1995.240, an unreasonable delay in responding to a written request can itself be treated as consent — this form creates the written record of when the request was made, which matters if that situation comes up.

Does consenting to a sublet release the original tenant from the lease?

No. Unless the landlord separately and explicitly agrees to release the original tenant, that tenant remains fully responsible for rent and all lease obligations even after a sublet is approved.

Can a landlord charge a fee just to process this consent request?

Any fee to screen a proposed subtenant is generally subject to the same application-fee cap under Cal. Civil Code §1950.6 that applies to a regular rental applicant — it cannot exceed the landlord's actual screening cost.

Is this form required by law?

No specific form is required by statute, but documenting the request and the landlord's response in writing — rather than relying on a verbal conversation — protects both parties if a dispute comes up later.
