Is the rent stabilization rider required for every lease?
It is required whenever the apartment is subject to rent stabilization — for both the initial lease and every renewal. It is not required for market-rate (non-stabilized) units.
Can I write my own version of the rider instead of using the official form?
No. Because the rider must reflect the specific legal regulated rent history for that unit and is a state-prescribed disclosure, you should always use the current official DHCR form rather than a homemade substitute.
Is the rider available in languages other than English?
HCR provides the rider in several of the languages required under New York's tenant-notice laws where available. Check the current official page for the languages currently offered before providing it to a tenant who reads a language other than English.
What happens if a landlord doesn't attach the required rider?
Failing to provide the required rider can expose a landlord to disputes over the lease and the calculated rent, and is treated as a compliance failure under rent-stabilization law. This is a legal requirement, not optional paperwork — always confirm you have the current version before signing.
