Agreement For renters

Sublease agreement (Dallas-Fort Worth)

Legal advice recommended before use.

Texas has no statewide statute granting a right to sublet — it's entirely a matter of your lease, which may require your landlord's written consent or prohibit subletting outright. Get that consent in writing before using this agreement. Remember: in a standard sublease, you remain the tenant of record and fully responsible to your landlord — this agreement protects you against your subtenant, not against your landlord.

Frequently asked questions

Do I need my landlord's permission to sublet in Texas?

Check your lease — Texas has no statewide statute granting a right to sublet, so it's governed entirely by whatever your lease says. Many leases require written landlord consent or prohibit subletting outright; subletting in violation of that clause is a lease violation.

Am I still responsible for rent if my subtenant doesn't pay me?

Yes. In a standard sublease, you remain the tenant of record on the original lease and fully responsible to your landlord regardless of whether your subtenant pays you. This agreement gives you a basis to pursue your subtenant directly, separate from your landlord obligation.

Can the sublease run longer than my original lease?

No — a sublease can't extend beyond the term of the original lease, since you can't sublet rights you won't still hold.

Is this the same as an assignment?

No. In this sublease, you stay on the original lease and remain responsible to the landlord. An assignment transfers your entire interest to someone else, who becomes the tenant of record in your place — a different arrangement your landlord would need to separately approve.
