Lease guarantor agreement (Dallas-Fort Worth)

Legal advice recommended before use.

When a tenant's income or credit is thin, a guarantor (often a relative) can agree to cover the rent if the tenant doesn't. Texas law narrowly limits how long that promise lasts: under Tex. Prop. Code § 92.021, a lease guarantor is liable only for the original lease term, unless the lease itself, in writing, specifically states the guarantor also covers renewals up to a stated end date, with no rent increase and the same parties. A guarantor can also separately, voluntarily sign a new agreement at renewal to cover an increased rent obligation. Beyond this one statute, ordinary Texas contract law governs the guaranty.

A guaranty is a serious financial obligation for the guarantor — both landlord and guarantor should have it independently reviewed before signing. See Tex. Prop. Code § 92.021 for the statutory term limitation.

Frequently asked questions

How long is a guarantor responsible for a Texas lease?

Under Tex. Prop. Code § 92.021, a guarantor is liable only for the original lease term, unless the lease itself, in writing, specifically states the guaranty also covers renewals up to a stated end date, with no rent increase and the same parties.

What if the tenant renews the lease at a higher rent?

The guarantor is not automatically bound to cover an increased rent obligation at renewal unless the original guaranty said so under the conditions in § 92.021. A guarantor can, however, voluntarily sign a new agreement at renewal to cover the increased rent.

Does Texas have a broader guarantor regulatory scheme like some cities have for tenants?

No — Tex. Prop. Code § 92.021 is a narrow, liability-duration-limiting statute. Beyond it, ordinary Texas contract law governs the guaranty; there is no separate Texas guarantor-specific regulatory scheme comparable to some NYC guarantor rules.

Can the guaranty cover repair costs and late fees, not just rent?

Yes, if the guaranty says so — this template covers rent, lawful late fees under § 92.019, and damage beyond normal wear and tear, all limited to the original lease term unless the renewal box is completed.

Do I need a lawyer to use this guaranty?

Yes, before relying on it. This is a template, not legal advice, and this document has not yet been reviewed by a licensed Texas attorney.
