Month-to-month rental agreement (Dallas-Fort Worth)

建议在使用前咨询律师。

A month-to-month agreement lets either party end the tenancy with proper notice. In Texas, absent a lease clause saying otherwise, either party may give notice under Tex. Prop. Code § 91.001, and termination is effective on the later of the date stated in the notice or one full rental period after the notice is given — the same rule applies whether the landlord or the tenant is the one ending it. This rule doesn't apply to a termination for lease breach.

Template, not legal advice. Termination notice for a month-to-month tenancy is governed by Tex. Prop. Code § 91.001 (notice effective on the later of the stated date or one full rental period after notice); the security deposit has no statutory cap (§ 92.102) but must be returned within 30 days (§ 92.103) minus only lawful deductions (§ 92.104). IMPORTANT: this specific document has not yet been reviewed by a licensed Texas attorney — do not rely on it, sign it, or send it to a tenant until it has been.

常见问题

Is this Texas month-to-month rental agreement template free?

Yes. You can fill it in on this page and download a completed document for free — no account required. It is a starting-point template, not legal advice, and has not yet been reviewed by a Texas-licensed attorney.

How much notice does a Texas landlord need to end a month-to-month tenancy?

Under Tex. Prop. Code § 91.001, absent a lease clause saying otherwise, notice given by either party ends the tenancy on the later of the date stated in the notice or the end of one full rental period after the notice was given. This rule doesn't apply to a termination for lease breach.

Is there a cap on the security deposit in Dallas-Fort Worth?

No — Texas sets no statutory cap on the deposit amount (Tex. Prop. Code § 92.102). The deposit must be returned within 30 days of move-out, minus lawful deductions only (§ 92.103-92.104).

How much notice is required before a rent increase?

Texas has no separate statute specifically governing rent-increase notice for month-to-month tenancies; a rent increase functions like a change to the terms of tenancy and follows the same notice logic as ending the tenancy under Tex. Prop. Code § 91.001.

Do I need a lawyer to use this lease?

Yes — have a Texas-licensed attorney review this specific document before you rely on it, sign it, or send it to a tenant.
